Terms and conditions
This is a courtesy translation. In case of any difference, the Dutch version prevails.
1. General
1.1 These terms and conditions apply to all quotes, agreements, assignments and services of FIXEDBYIGGNICK, unless otherwise agreed in writing.
1.2 By using our services, the client agrees to these terms and conditions.
2. Services
2.1 FIXEDBYIGGNICK provides, among other things: recording sessions, mixing, mastering, production work and related studio work.
2.2 Changes outside the agreed service package may incur additional costs.
3. Prices and payment
3.1 All prices exclude VAT, unless stated otherwise.
3.2 Payment must be made within 14 days of the invoice date.
3.3 If payment is not received, FIXEDBYIGGNICK reserves the right to suspend further services and/or not deliver the final product.
3.4 Additional revisions or session time are charged separately at the applicable hourly rate.
3.5 If the payment term is exceeded, the client is automatically in default. Interest of 1% per month (or part thereof) is then charged on the outstanding amount, without a notice of default being required.
3.6 All costs FIXEDBYIGGNICK incurs to collect outstanding amounts are borne by the client. These costs are calculated in accordance with the Dutch Collection Costs Act (Wet Incassokosten, WIK).
4. Cancellation & no-show
4.1 Cancellation of a session must be reported at least 24 hours in advance.
4.2 For cancellations within 24 hours, 50% of the agreed amount is charged.
4.3 In the event of a no-show, 100% of the session costs are charged.
5. Liability
5.1 FIXEDBYIGGNICK is not liable for loss of, damage to or delay of files as a result of force majeure, technical failures or other external factors.
5.2 Making backups of recordings and files is the responsibility of the client.
5.3 The client is fully liable for all damage to studio equipment caused by improper use, negligence or intent. FIXEDBYIGGNICK accepts no liability for damage caused by third parties while using the facilities.
6. Intellectual property
6.1 The client remains the owner of the original music and recordings.
6.2 The delivered mix/master remains the property of FIXEDBYIGGNICK until full payment has been made.
6.3 FIXEDBYIGGNICK reserves the right to use parts of the final product for promotional purposes, unless the client objects to this in writing in advance.
7. Revisions
7.1 The price for mixing and mastering services includes up to 3 rounds of revisions.
7.2 After delivery of the final round of revisions, the "lock phase" begins: further changes are then no longer included. Additional revisions are invoiced separately at the applicable hourly rate or per round of revisions.
8. Delivery
8.1 The standard delivery time for mix/master services is 5 working days, unless otherwise agreed.
8.2 Rush deliveries are possible for an additional fee.
9. Confidentiality
9.1 All files and information provided are treated confidentially and are not shared with third parties without permission.
10. Governing law
10.1 All agreements are governed by Dutch law.
10.2 Disputes are preferably resolved by mutual agreement. If that is not possible, they are submitted to the competent court in the district where FIXEDBYIGGNICK is established.
